Terms of Service

Penmar Press, LLC (the “Company”) offers Shesaurus.com (the “Website”) according to the Terms of Service declared below.  Penmar Press reserves the right to modify these terms without notice.   Unauthorized use or violation of copyrights will be subjected to licensing fees outline below under, Licensing.   Your continued usage of Shesaurus.com constitutes your acceptance of these terms, available at http://www.shesaurus.com/term.   Violation of any terms will  result in removal of your postings and termination of your user account. 1.1 These Terms of Service constitute the agreement between Shesaurus.com and Penmar Press LLC (“Shesaurus.com”) and you as a user who accesses, subscribes to access or otherwise establishes a connection (“user,” “you,” or “your”) to the world wide web sites known as Shesaurus.com, Hesaurus.com, Hesaurus-shesaurus.com, Penmarpress.com (individually and collectively, the “Site” and including any sub-domains, “premium” sites or other related to Shesaurus.com products and services), which are owned and controlled by Penmar Press LLC.

1.2 You must agree to abide by all of the provisions in this agreement in order to remain an authorized user of the Site and your use of the Site constitutes your agreement to abide by those provisions. You are solely responsible for your use of the Site and for ensuring that your use complies fully with the provisions of this agreement. Your rights are personal and non-assignable. This means that you will be responsible for the acts of anyone accessing the Site through you or using your name and login or email address.

1.3 Shesaurus.com reserves the right, in its sole discretion, to change any or all of the provisions of this agreement at any time. Shesaurus.com will notify users of any changes by posting them on the Site or through other reasonable means of providing notice. Any changes to this agreement will be effective immediately upon notice to you. Your use of the Site after notice of changes to this agreement will be deemed your acceptance of the changes.

1.4 Shesaurus.com reserves the right, in its sole discretion, to change, limit, or discontinue any aspect, content, or feature of the Site, as well as any aspect pertaining to the use of the Site.

1.5 IF YOU DO NOT AGREE TO THE PROVISIONS OF THIS AGREEMENT OR ARE NOT SATISFIED WITH THE SITE AND ITS CONTENTS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE OF THE SITE IMMEDIATELY,  IF NOT SOONER.

Usage Terms

    1. Shesaurus.com is not suitable for all audiences. Its content is frequently presented in a coarse, dark, comical, brash and direct manner that some may find offensive. If you do not consider yourself an appropriate user or are offended, PLEASE DO NOT VISIT Shesaurus.com.
  • Shesaurus.com is not intended for children under 13. By using Shesaurus.com, you are representing that you are at least 18, or that you are at least 13 years old and have your parents’ permission to use Shesaurus.com.

 

  1. You may not use Shesaurus.com for any illegal activity or to violate laws in your jurisdiction.
  2. You may not exploit Shesaurus.com to access unauthorized information.
  3. Penmar Press, LLC reserves the right to modify, suspend, or discontinue Shesaurus.com for any reason, with or without notice.
  4. Shesaurus.com is provided “as is” and “as available”. You assume complete responsibility and risk for your use of Shesaurus.com. Penmar Press, LLC does not warrant that (i) Shesaurus.com will meet your requirements, (ii) you will be satisfied with Shesaurus.com, (iii) you will at all times be able to use Shesaurus.com, (iv) Shesaurus.com will be without errors, (v) or that any errors will be corrected.
  5. Penmar Press, LLC or Marquisha Gatewood is not responsible for any damages or loss resulting from your use of Shesaurus.com.
  6. Any failure of Penmar Press, LLC to enforce or exercise a right provided in these terms is not a waiver of that right.
  7. Should any provision of this Terms of Service be found invalid or unenforceable, the remaining terms shall still apply.
  8. This Terms of Service constitutes the entire agreement between you, Marquisha Gatewood and Penmar Press, LLC and supersedes any and all previous agreements, written or oral, between you Marquisha Gatewood and Penmar Press, LLC, including previous versions of the Terms of Service.

User Conduct

  1. Users may not post Content (as defined below) that:
  1. is unlawful, threatening, libelous or defamatory;
  2. violates any party’s intellectual property; or
  3. is detrimental to the quality or intended spirit of Shesaurus.com.
  1. Examples of unacceptable Content or behavior on Shesaurus.com include:
  1. abuse, harassment, threats of violence, flaming, intimidation of any person or organization, or any other threatening behavior;
  2. engaging in or contributing to any illegal activity or activity that violates others’ rights;
  3. providing information that is false, misleading or inaccurate;
  4. hacking or modifying Shesaurus.com to falsely imply an association with Penmar Press, LLC;
  5. implying or pretending to be affiliated with a company or organization with which you are not affiliated, or misrepresenting the extent of your affiliation or role with an affiliated company or organization; or
  6. disclosing personal or proprietary information of another user, person or organization.
  1. Penmar Press, LLC has the right, but not the obligation, to limit or revoke the use privileges or user account of anyone who posts unacceptable Content.
  2. At any time, Penmar Press, LLC can refuse to allow a posting or remove a posting at its sole discretion. However, Shesaurus.com is not obligated to restrict or monitor submissions in any way, or to block users who submit inappropriate content.
  3. By submitting Content, you represent and warrant that such Content:
  1. shall not violate the rights of any third party, including, but not limited to, intellectual property and proprietary rights;
  2. shall not be fraudulent or involve counterfeit or stolen information or items;
  3. shall not violate any law, statute, ordinance or regulation; and
  4. shall not create any liability for Penmar Press, LLC or any of its respective parents, subsidiaries, affiliates, successors, assigns, writers, webmasters, employees, agents, directors, officers and shareholders.
  5. You warrant that any material or information that you make available through the Site, including, for example, postings to comment sections and forums, is solely your original work, or that you have all necessary rights to make the material or information of any other person or entity available on the Site. You will be solely responsible for the content of any material or information that you make available through the Site. You will also be liable for any damage resulting from making any material or information available through the Site.

You may not submit Content using unauthorized automated methods (“bots”).  You may not remove, alter, copy content, copy words or access copyrighted content on our database without authorization or using unauthorized automated methods (“bots”).   Unauthorized automated methods (“bots”) will be subject to licensing fees outlined under Licensing.
  2. Penmar Press, LLC cannot control all Content posted by third parties to Shesaurus.com, and does not guarantee the accuracy, integrity or quality of such Content. You understand that by using Shesaurus.com you may be exposed to Content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will Penmar Press, LLC be liable in any way for any Content, including any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of your use of any Content. User Account Terms

  1. Penmar Press, LLC can refuse registration for a user account at its sole discretion at any time.
  2. You are responsible for using Shesaurus.com in a private and secure manner. Penmar Press, LLC is not liable for any damage or loss due to unauthorized user account access resulting from your actions, such as sharing your user account password or not logging out of Shesaurus.com.
  3. You may not register user accounts by utilizing bots.
  4. Penmar Press, LLC reserves the right to suspend or terminate your user account at any time for any reason, and is not liable for any damage or loss resulting from such suspension or termination.

Copyright and Ownership

  1. Marquisha Gatewood owns intellectual property rights to any protectable part of Shesaurus.com, including but not limited to the content, database, design, artwork, functionality, and documentation. You may not copy, deploy robots, duplicate, modify, or reverse engineer any part of Shesaurus.com owned by Marquisha Gatewood.  If you would like to license or obtain rights to the database, please contact Penmar Press, LLC at, mgatewood@shesaurus.com.
  2. Any words, definitions, or other information (collectively, “Content”) posted on Shesaurus.com shall remain our sole and exclusive property.
  3. When you post Content on Shesaurus.com, you agree to grant Penmar Press, LLC an irrevocable, perpetual, worldwide, royalty-free, fully sublicenseable, non-exclusive license to copy, distribute, sell, publicly display, publicly perform and make derivative works of your Content on Shesaurus.com, on services affiliated with Shesaurus.com and elsewhere (including but not limited to print, video, audio or computer media), regardless of the form of media used or of whether such media or services now exist or are developed in the future. By posting Content to Shesaurus.com, you hereby represent and warrant that you have the right to post that Content and to grant the foregoing rights to Penmar Press, LLC.
  4. Penmar Press, LLC is not liable for any damages or losses resulting from Shesaurus.com transmitting information such as personal messages over unencrypted networks such as email.
  5. Penmar Press, LLC respects the intellectual property of others. It may, in appropriate circumstances and at its discretion, disable and/or terminate the user accounts of users who repeatedly infringe others’ rights.
  6. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide the following information to Penmar Press, LLC’s copyright agent:
  1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
  2. a description of the copyrighted work or other intellectual property that you claim has been infringed;
  3. a description of where the material that you claim is infringing is located on the site;
  4. your address, telephone number, and email address;
  5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the copyright or intellectual property owner’s behalf.

Licensing

Unauthorized use of copyrighted content, use of database, use of artwork, use of logo or masthead is prohibited.  Basically, if you  copy any content from our copyrighted database you are agreeing to the following terms of this license.  You the “LICENSEE” will pay Marquisha Gatewood $1.50/word for every term, related word or synonym copied, collected without authorization from our copyrighted database.

 

Participation Disclaimer

  1. Penmar Press, LLC does not and cannot review all Content posted to or created by users accessing Shesaurus.com, and is not in any manner responsible for the content of these communications or the activities of these users.
  2. You acknowledge that by providing you with the ability to view and distribute user-generated content through Shesaurus.com, is merely acting as a passive conduit for the distribution of such information and is not undertaking any obligation or liability relating to the Content or Shesaurus.com users’ activities.
  3. Penmar Press, LLC and its respective parents, subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers and shareholders do not undertake or assume any duty to monitor Shesaurus.com for inappropriate Content.
  4. Penmar Press, LLC and its respective parents, subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers and shareholders assume no responsibility or liability which may arise from the Content thereof, including, but not limited to, claims for defamation, libel, slander, infringement, invasion of privacy and publicity rights, obscenity, pornography, profanity, fraud, or misrepresentation.

Access to the Shesaurus dictionary API is available only with the express permission of Marquisha Gatewood and is governed by the Shesaurus API Terms of Service.

Privacy Policy

Shesaurus.com, Penmar Press, LLC respects your privacy. When you use Shesaurus.com, Hesaurus-shesaurus.com, Celebsguidetoprison.com or any other online products or websites that we own (our “sites”) and mobile applications (our “apps”), we collect information about you and use it to facilitate and improve our services. Information about you may also be shared with other companies. For instance, companies engaged in “targeted” or “behavioral” advertising present ads that might be of interest to you based on information about your online activities. We want to be clear about how information about you may be used and what your privacy options are.

Penmar Press, LLC (“Penmar Press”, “we” or “us”) collects (a) the e-mail addresses of those who communicate with us via e-mail, (b) aggregate information concerning what pages users access or visit, (c) information volunteered by the user (such as survey information and/or site registrations) and (d) information related to your use of the site, including IP address, geographic location and date and time of your request. Information Gathering and Usage

When you submit a posting to on Shesaurus.com we ask for information such as your email address and name.   Shesaurus.com uses collected information for the following general purposes: products and services provision, identification and authentication, services improvement, contact, and research.  We use your email address only to allow you to log in to your account, send you confirmations, add words to our database and to send you messages as part of our services.  We will also use your email address to respond to your customer service inquiries.

Cookies and Web Beacons

A cookie is a small amount of data, which often includes an anonymous unique identifier, which is sent to your browser from a website’s computers and stored on your computer’s hard drive. Cookies are required to use some of Penmar Press’ services. Penmar Press and its ad management partners (“Ad Partners”) use cookies to record current session information.

Our Ad Partners may also from time to time use web beacons (also known as Internet tags, pixel tags and clear GIFs). These web beacons are provided by our Ad Partners and allow Ad Partners to obtain information such as the IP address of the computer that downloaded the page on which the beacon appears, the URL of the page on which the beacon appears, the time the page containing the beacon was viewed, the type of browser used to view the page and the information in cookies set by the Ad Partners. Web beacons enable our Ad Partners to recognize a unique cookie on your web browser, which in turn enables us to learn which advertisements bring users to our Website.

With both cookies and web beacon technology, the information that we collect and share is anonymous and not personally identifiable. It does not contain your name, address, telephone number, or email address.

Data Storage

Penmar Press uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run Shesaurus.com. Penmar Press owns the codes, databases, and all rights to the Shesaurus.com application.

Security

We take precautions to ensure the security of your personal information. However, we cannot guarantee that hackers or unauthorized personnel may gain access to your personal information despite our efforts. You should note that in using the services ofShesaurus.com your information will travel through third party infrastructures which are not under our control.

We cannot protect, nor does this Privacy Policy apply to, any information that you transmit to other users. You should never transmit personal or identifying information to other users.

Children

The Shesaurus.com database service is not intended for children under 13, and we do not knowingly collect information from children under the age of 13.

Children aged 13 or older should not submit any personal information without the permission of their parents or guardians. By using the Shesaurus.com database service, you are representing that you are at least 18, or that you are at least 13 years old and have your parents’ or guardians’ permission to use the service.

Changes

Penmar Press, LLC may periodically update this policy. We may notify you about significant changes in the way we treat personal information by placing a prominent notice on our site.

YOUR CALIFORNIA PRIVACY RIGHTS (as provided by California Civil Code Section 1798.83)

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California customer”) is entitled to request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes.
